What you will learn

The programme is built lesson by lesson on the RICS practice statement and guidance note Surveyors acting as expert witnesses — 4th edition, amended 2023 — and applies it to Egyptian courts under Law 96 of 1952 on experts before the courts, the Evidence Law 25 of 1968 and the Arbitration Law 27 of 1994, and to international arbitration under the IBA Rules on the Taking of Evidence 2020 and the CIArb protocol for party-appointed experts. Six modules and twelve lessons follow the life of an appointment:

  • Module 1 — The expert witness role and the overriding duty to the tribunal: independence, impartiality, completeness.
  • Module 2 — Appointment, instructions, conflicts of interest and fees, including why conditional fees are prohibited.
  • Module 3 — Investigation, inspection and evidence: facts versus opinion, assumptions and ranges of opinion.
  • Module 4 — The expert witness report: mandatory contents, the statement of truth and the declarations.

البرنامج مبني درسًا درسًا على بيان الممارسة والمذكرة الإرشادية لـ RICS «المسّاحون العاملون كخبراء شهود» — الطبعة الرابعة المعدّلة 2023 — ويطبّقها على المحاكم المصرية وفق القانون 96 لسنة 1952 بشأن تنظيم الخبرة أمام جهات القضاء وقانون الإثبات 25 لسنة 1968 وقانون التحكيم 27 لسنة 1994، وعلى التحكيم الدولي وفق قواعد IBA لأخذ الأدلة 2020 وبروتوكول CIArb لخبراء الأطراف. ست وحدات واثنا عشر درسًا تتبع دورة حياة التكليف:
